DRAFT AMENDMENT TO COFFS HARBOUR LOCAL ENVIRONMENTAL PLAN 2013 (PLANNING PROPOSAL PP-2022-1968; Renewal of Argyll Estate Precinct); DRAFT COFFS HARBOUR DEVELOPMENT CONTROL PLAN 2015 – AMENDMENT No. 34 (Argyll Estate Precinct); DRAFT ARGYLL ESTATE PRECINCT CONTRIBUTIONS PLAN

Council at its Ordinary meeting of 26 May 2022 resolved to initiate an amendment to Coffs Harbour Local Environmental Plan (LEP) 2013 to allow the redevelopment of land within the Argyll Estate Precinct for a range of medium density residential development. Council at its Ordinary meeting of 11 August 2022 resolved to publicly exhibit a draft amendment to Coffs Harbour Development Control Plan (DCP) 2015 and draft Argyll Estate Precinct Contributions Plan to support the proposed LEP amendment.

The objective of the proposed amendment to Coffs Harbour LEP 2013 is to facilitate the redevelopment of land within the Argyll Estate Precinct for a range of medium density dwelling types including residential flat buildings and dual occupancies.

The intended outcomes of the proposed LEP amendment are:

  1. To provide for renewal of the site to deliver housing growth and a greater mix of housing types and dwelling sizes in accordance with the Coffs Harbour Regional City Action Plan 2036 and Coffs Harbour Local Growth Management Strategy 2020 (LGMS).
  2. To facilitate infill development in the Bray Street Infill Area consistent with the LGMS.
  3. To increase the supply of smaller, more affordable dwelling types, including dual occupancies and apartments, to address the shortage of smaller dwellings in the Coffs Harbour LGA.
  4. To deliver development which is compatible with the environmental constraints and natural hazards of the precinct, including; ecological values, bushfire hazard and flood hazard.
  5. To ensure future built form is appropriate for the local character and climate of Coffs Harbour and provides an appropriate transition to existing, surrounding dwellings.
  6. To provide for renewal of existing social housing to better meet demand and deliver new private housing in accordance with NSW Government’s Future Directions for Social Housing Strategy.

 

On the 23 June 2022, the Minister for Planning determined pursuant to Section 3.34(2) of the Environmental Planning and Assessment Act 1979 that the proposed LEP amendment could proceed.

In accordance with the Minister’s determination and Council’s resolution, the proposed LEP, draft DCP amendment and draft Contributions Plan are now publicly available for community consultation.

The exhibition period is from Wednesday, 17 August 2022 to close of business on Wednesday, 14 September 2022. The proposed LEP, draft DCP amendment and draft Contributions Plan can be viewed online on Council’s Have Your Say Page: www.haveyoursay.coffsharbour.nsw.gov.au where online submissions can be made. Written submissions can also be made to the General Manager, Coffs Harbour City Council, Locked Bag 155, Coffs Harbour 2450 or emailed to coffs.council@chcc.nsw.gov.au. Submissions must be received by no later than close of business Wednesday, 14 September 2022.

Council is committed to openness and transparency in its decision making processes. The Government Information (Public Access) Act 2009 requires Council to provide public access to information held unless there are overriding public interest considerations against disclosure. Any submissions received will be made publicly available unless the writer can demonstrate that the release of part or all of the information would not be in the public interest. However, Council would be obliged to release information as required by court order or other specific law.

Written submissions must be accompanied, where relevant, by a “Disclosure Statement of Political Donations and Gifts” in accordance with the provisions of the Local Government and Planning Legislation Amendment (Political Donations) Act 2008 No. 44.
